(English) Spanish tax authorities to punish tax havens advisers

The Spanish tax authorities want to reward tax advisers who inform about violations and tax evasion with preferential treatment. For this purpose the tax authorities have presented a Code of Best Tax Practices to associations for tax advisers. The endorsement of the code is voluntary.

The Spanish tax authorities want to reward tax advisers who inform about violations and tax evasion with preferential treatment. For this purpose the tax authorities have presented a Code of Best Tax Practices to associations for tax advisers. The endorsement of the code is voluntary.

It is, in fact, two codes that the Tax Authorities have created. The first is for associations and the second is for professionals, although the latter basically inform the association to which they are affiliated.

Intermediaries who endorse the code must help to avoid or correct irregularities

 

Associations and colleges for tax advisers, in turn, inform the Tax Authorities about possible violations and irregularities among members that may have consequences for the functioning of the system or the competitive position on the market.

Intermediaries who endorse the code must help to avoid or correct irregularities that may entail significant tax risks, based on the quality standards established by associations themselves.

Specifically, they are forbidden to advise in illegal operations (double accounting, software that makes this possible, etc.) and also in a number of operations that are legally permitted, such as the use of tax havens.

Quality stamp

In exchange, the Tax Authorities will give the associations for tax advisers a quality stamp. In addition, the Tax Agency is committed to establishing a direct communication channel with the members, facilitating procedures, and customizing the management.
