{"id":15638,"date":"2021-02-19T14:59:44","date_gmt":"2021-02-19T13:59:44","guid":{"rendered":"https:\/\/www.euroeconomics.com\/c19-update-belangrijke-nieuwe-erte-maatregelen\/"},"modified":"2022-02-11T16:46:16","modified_gmt":"2022-02-11T15:46:16","slug":"emergency-measure","status":"publish","type":"post","link":"https:\/\/www.euroeconomics.com\/en\/emergency-measure\/","title":{"rendered":"Covid-19 emergency measure updates Spain"},"content":{"rendered":"<p>The Spanish government will most probably announce next week additional measures for companies that apply the\u00a0<strong>temporary termination of employment contracts or the reduction of working hours<\/strong>\u00a0as a direct consequence of the COVID19 crisis (<strong>ERTE Force Majeure<\/strong>). Here is a summary of our expectations:<\/p>\n<h2>Untill 30 June and flexibility<\/h2>\n<ul>\n<li>The ERTE Force Majeure is no longer dependent on the duration of the current state of emergency but will automatically\u00a0<strong>continue until 30\/06\/2020<\/strong>;<\/li>\n<li>Companies can maintain the ERTE until that date and in the meanwhile still\u00a0<strong>gradually reinstate partially or fully some or all of the employees<\/strong>;<\/li>\n<li>For employees returning to work, there is an\u00a0<strong>exemption on employer contributions<\/strong>\u00a0of\u00a0<strong>85% in May<\/strong>\u00a0and\u00a0<strong>70% in June<\/strong>\u00a0for companies with less than 50 employees (for companies with more employees, this is\u00a0<strong>60%<\/strong>\u00a0and\u00a0<strong>45%<\/strong>\u00a0respectively);<\/li>\n<li>For those workers who do not yet return to work, there is an exemption from employer contributions of\u00a0<strong>60% in May<\/strong>\u00a0and\u00a0<strong>45% in June<\/strong>\u00a0for companies with less than 50 employees (and\u00a0<strong>45%<\/strong>\u00a0and\u00a0<strong>30%<\/strong>\u00a0for companies with more employees);<\/li>\n<li>Companies that remain completely inactive will benefit from the current exemptions (100% and 75% respectively);<\/li>\n<li>Companies with more than 50 employees using an ERTE Force Majeure are\u00a0<strong>not allowed to pay dividends<\/strong>\u00a0during the current tax year;<\/li>\n<li>Companies from severely affected sectors may be able to extend the ERTE Force Majeure after 30\/06\/20 (the government will decide on this later);<\/li>\n<li>Companies that are not in these severely affected sectors and wish to extend the ERTE after 30\/06\/20 must agree an\u00a0<strong>ERTE for productive, organizational or technical reasons<\/strong>\u00a0with their employees (without exemption from employer contributions).<\/li>\n<\/ul>\n<h2>Maintaining employees<\/h2>\n<p>One of the conditions of the ERTE Force Majeure was\u00a0<strong>that the workforce must be maintained for 6 months after the ERTE ended<\/strong>. This caused a great deal of unrest among the entrepreneurs, as there was no clarity as to how this was to be carried out.
