The Spanish government offers entrepreneurs\u00a0the opportunity to defer payment of business rentals\u00a0in case\u00a0business activity has been\u00a0shut down\u00a0by the government as a result of the state of emergency\u00a0(such as catering or retail) or if, in case of\u00a0continuing business activity,\u00a0turnover has fallen by at least 75%\u00a0compared to the same period last year.\u00a0<\/strong><\/p>\n

Interest-free deferment<\/h2>\n

The measure allows tenants to defer the payment of business rentals\u00a0without any\u00a0interest<\/strong>\u00a0during he duration of the state of emergency\u00a0and\u00a0repay it in\u00a024 equal installments<\/strong>\u00a0during the two years following the end of the state of emergency. The landlord can offer alternative solutions, such as a rent reduction.<\/p>\n

Not for all tenants\/landlords, for whom?<\/h2>\n

The measure only applies to\u00a0self-employed entrepreneurs<\/strong>\u00a0(so-called aut\u00f3nomos) and\u00a0SMEs<\/strong>\u00a0(PYMES).<\/p>\n

Only\u00a0public rental organizations<\/strong>\u00a0and \u201clarge\u00a0landlords<\/strong>\u201d are required to accept the postponement of the rent. Large landlords include all owners of\u00a0a minimum of 10 rental properties or landlords who\u00a0rent out a total of more than 1,500m2 of industrial space.<\/p>\n

Who is\u00a0a \u201clarge\u00a0landlord\u201d?<\/h2>\n

There is\u00a0no clear register or database<\/strong>\u00a0for this category of landlords. If you think that this measure applies to your lease, we would advise you\u00a0to request the postponement referring to\u00a0this measure. If you receive a negative answer and are not sure, there are several registers and public databases that can be consulted that demonstrate the landlord’s situation with reasonable certainty.<\/p>\n

How do I request deferment?<\/h2>\n

You must submit the application to your landlord\u00a0within one month, i.e. before May 23, 2020<\/strong>. We can help you with this. Depending on your situation, the landlord may, for example, request tax certificates or access to your administration\u00a0to determine whether you are indeed entitled to this postponement.<\/p>\n
