With the recently approved Labour Reform, the Spanish government has imposed even more severe restrictions on temporary employment contracts.<\/strong><\/p>\n

In this newsletter, we briefly explain the limited options that from now on are available for these kinds of contract.<\/p>\n

Temporary contracts just in exceptional cases<\/h2>\n

The starting point of the Spanish Government is that\u00a0employees should have a permanent contract as standard<\/strong>\u00a0and that it is only possible to offer them\u00a0a temporary contract in a few exceptional situations<\/strong>.<\/p>\n

In the case of\u00a0foreseeable situations<\/u>\u00a0(e.g. trade fairs, congresses), it remains possible to hire temporary staff, however, with\u00a0a limit of just 90 days per year, calculated over the entire workforce<\/strong>\u00a0(!).<\/p>\n

In\u00a0situations that cannot be foreseen<\/u>\u00a0(e.g. temporary projects, replacement due to holidays of other employees), temporary staff can be hired with\u00a0a limit of 6 months<\/strong>\u00a0(in the future this period may be extended for certain collective bargaining agreements).<\/p>\n

However, in both situations it is very important that the contract specifies in detail the\u00a0exact reason<\/strong>\u00a0and how this reason is\u00a0related to the duration<\/strong>\u00a0of the contract.<\/p>\n

Temporary contracts without valid cause can lead to\u00a0significant penalties<\/strong>\u00a0(up to 10,000 euros per employee).\u00a0<\/strong><\/p>\n
